Privacy
This agreement describes the terms and conditions under which the "GalaxyPay" service is provided. Before using this service, the person must fully read and agree with the following. In case of refusal to read or disagreement with the contents - the service is not provided to the person.
This agreement is publicly available on the "GalaxyPay" web page and can be unilaterally changed by the Service Management without further notice to the User.
The parties to this agreement are GalaxyPay (hereinafter referred to as the "Service") and the individual using the Service (hereinafter referred to as the "User").
1. Applicable terms and definitions
1.1. "GalaxyPay" is a service of providing access to the use of Bitcoin and other cryptocurrencies. The Service Features are delivered to the User via the secure website of "GalaxyPay";
1.2. User - a natural person who uses the Service Features. Other persons are not allowed to use the Service;
1.3. Bitcoin - an electronic unit of account stored in a decentralized, public blockchain database, which has the property of non-refundability and genuineness of transactions;
1.4. Payment System - a hardware and software complex developed by a third party and representing a mechanism for implementing the accounting of financial or other obligations and organizing mutual settlements between users;
1.5. Opportunities of the Service - performance of Bitcoin transfer operations, as well as other opportunities to work with Bitcoin, information about which is placed on the pages of the Service website;
1.6. Payment (transaction) - the procedure of changing the holder of electronic currency, bitcoin or other currency;
2. Introduction
2.1 This Agreement regulates the relationship between the User and the Service in the matter of the User's ability to use Bitcoin through the Service;
2.2 This Agreement does not supersede the applicable laws of the countries of registration and location of the Service and the User and/or the contractual relationship between the User and the Payment Systems. If according to the current legislation or other obligations the User has no right to use the Service, the use of the Service is prohibited;
2.3 The Service guarantees and ensures confidentiality of information about the User and his/her transactions. The Service may provide personal information at the request of authorized state bodies and/or representatives of Payment Systems, but with mandatory compliance with legal grounds;
3. Subject of the agreement
3.1 The subject of this agreement is the obligation of the Service to store, provide input, withdrawal, receipt and reimbursement of Bitcoin belonging to the User, on behalf of the User;
3.2. The Service does not undertake the obligation to check the legality of the User's possession of Electronic Currencies, bitcoin and/or financial means and does not supervise the User's operations in Payment Systems;
3.3 Payment systems and/or financial institutions are solely responsible for the funds entrusted to them by the User. The Service cannot be a party to the agreement between the Payment system and/or financial institution and the User and does not bear responsibility for illegal use of the Payment system possibilities by the User and also for abuse of the Payment system functionality by the User. Mutual rights and obligations of the User and the Payment system and/or financial institution are regulated by respective agreements;
3.4 Any completed e-currency transaction, as well as any other transaction offered by the Service to the User, is considered non-refundable, i.e. one that cannot be canceled (the User receives the funds due to him according to the initially accepted conditions);
3.5 The Service has the right to suspend or cancel the operation in progress if it receives reliable information about the User's unauthorized possession of electronic currencies or financial means and/or other information that makes it impossible to use the Service;
3.6 The Service has the right to suspend or cancel the operation in progress if the User violates the terms and conditions of this Agreement;
3.7. The Service has the right to cancel the operation in progress and return the electronic currencies and/or financial means deposited by the User without giving any reasons;
3.8 The User agrees to:
- to exclude any actions or complicity to actions in: illegal trade, carrying out financial frauds, using the Service for creation and distribution of financial pyramids, financing of terrorism, committing other illegal actions;
- not to carry out actions that may cause direct or indirect harm to the fight against money laundering and legalization of illegally obtained funds;
- not to use Bitcoin as a means of payment in the CIS;
3.9 The Service agrees to take all actions within the framework of the current legislation to prevent: illegal trade, financial fraud, money laundering, financing of terrorism, other actions violating the legislation. Also:
- within the framework of the current legislation and the obligations assumed by this Agreement to assist law enforcement agencies in tracking down and catching criminals using the Service Opportunities;
- improve the Service to prevent the use of the Service in illegal activities;
4. Opportunities of the Service
4.1 The Service ensures safety of Bitcoin, which the User entrusted to the Service for storage;
4.2 The Service provides the possibility for the User to create a personal Bitcoin purse, send and receive Bitcoin to it in the amounts entrusted by the User to the Service;
4.3. the Service provides identification of the User as a person who has access to the User's e-mail and cell phone number (with the ability to receive sms-messages), which the User indicated during his registration on the site;
5. Financial conditions
5.1 The Service transfers ownership rights to Bitcoin to the User and accepts ownership rights to Bitcoin from the User according to the tariffs specified on the Service's website;
5.2 Other tariffs and conditions are determined by the Service's management and published on the main and internal pages of the Service's website;
5.3 The Service's management has the right to change the Service's tariffs without additional notifications;
6. Taxation
6.1 The Service is not a tax agent for the User and does not notify the User about his tax obligations. The User independently pays any taxes required by the tax legislation in the place of his residence;
6.2 In the event that the state authorities legally require the Service to pay the User's taxes or cover the debt incurred as a result of the User's refusal to pay taxes, the User agrees to reimburse the Service for all costs incurred in connection therewith;
7. Guarantees and liability of the parties
7.1 The Service is provided on an "as is" basis - as described on the pages of the Service website;
7.2 The Service guarantees fulfillment of obligations to the User within the limits of the amounts entrusted by the User to the Service for the operation;
7.3 The Service undertakes to maintain, but does not guarantee its round-the-clock and daily (24/7) availability. The Service is not responsible for losses, lost profits and other costs of the User, resulting from the inability to access the Service website;
7.4 The Service is not responsible for losses, lost profits and other costs of the User, resulting from delays, errors or failures in making bank payments or electronic transfers;
7.5 The User guarantees that he is the owner or has the right to dispose of the funds he uses in his transactions;
7.6 The User undertakes not to falsify communication flows related to the operation of the Service;
7.7 The User acknowledges that the contents of the Service website are protected by intellectual property and copyright laws;
8. Force majeure
8.1 Neither the User nor the Service shall be liable to each other for delays or failure to fulfill their obligations due to force majeure circumstances, including natural disasters, fire, flood, acts of terrorism, change of power, as well as inoperability of Payment Systems, power supply systems, communication networks, SMS delivery services or Internet service providers.
