User Agreement
1. General provisions
1.1 This Agreement regulates the procedure and terms of service provision by the galaxy-pay.org service.
1.2. galaxy-pay.org is a hardware and software service located in the Internet at https://galaxy-pay.org.
1.3. galaxy-pay.org Administration - a person (persons) providing access to the galaxy-pay.org service.
1.4 Client - a person wishing to use the galaxy-pay.org service. 1.5. galaxy-pay.org Administration - a person(s) providing access to the galaxy-pay.org service.
1.5. galaxy-pay.org and the Customer are jointly referred to as the Parties.
1.6. The Parties recognize this Agreement in electronic form to be equal in legal effect to the Agreement concluded in writing.
1.7. This Agreement shall be deemed to be concluded on the terms of a public offer accepted by the Client during the submission of an application on https://galaxy-pay.org for the use of services provided by the service.
2. Subject of the Agreement
2.1. galaxy-pay.org renders services to the Client (clause 4 of the Agreement) in accordance with the regulations (clause 5 of the Agreement) subject to the mandatory conditions (clause 9 of the Agreement).
2.2 The Client uses the services of galaxy-pay.org and pays for them in accordance with the terms and conditions of this Agreement.
3. Rights and obligations of the parties
3.1. galaxy-pay.org undertakes to:
3.1.1. Provide the Client with electronic money exchange services of Bitcoin, Litecoin, Ethereum, Deposit BTC, Deposit USD payment systems, according to the rules and regulations of this Agreement.
3.1.2 Provide the Client with the necessary technical and consulting support related to the use and provision of galaxy-pay.org services via chat or ATS.
3.1.3. Store all information (addresses, amounts, time, identification data (personal data), etc.) for 6 months on Clients' exchange operations and provide it at the first request of the Clients to whom it relates, except for operations with anonymous payment systems.
3.1.4 Keep secret and do not disclose information on exchange operations, as well as personal data of galaxy-pay.org Clients to third parties, except for the following situations:
- by a lawful court decision at the location of the owner of the galaxy-pay.org service - at the lawful request of the competent authorities at the location of the owner of the galaxy-pay.org service - at the request of the administration of one of the payment systems, namely Bitcoin, Litecoin and others.
3.1.5 Transfer the funds due to the client or a third party to the specified details not later than 48 hours from the moment of the client's complaint about the non-arrival of funds after the exchange, in the cases described in paragraphs 3.2.5, 5.4, 5.5 and 5.6 of this Agreement.
3.2 The Client undertakes to:
3.2.1 Provide accurate and reliable payment details, both their own and those of third parties.
3.2.2 Provide an accurate, reliable and operable e-mail account.
3.2.3. to monitor the operability of his/her e-mail account and computer, including the use of up-to-date anti-virus software.
3.2.4. fulfill each clause of this Agreement.
3.2.5. Notify galaxy-pay.org administration about partial or full failure to receive funds to the specified details of the client or a third party as a result of the exchange, as well as about failure to receive funds in cases specified in clauses 5.4, 5.5 and 5.6 not later than 30 days from the date of failure to receive funds, otherwise these funds are at the disposal of galaxy-pay.org administration.
3.2.6 Provide a known correct cell phone number for registration, control (incoming) call from the security service of the service, receiving passwords, short text messages (SMS/SMS) and other ways of informing and additional identification for the galaxy-pay.org service.
3.2.7. not to violate the current legislation of the country where the Client is located by his/her actions when performing exchange operations with the help of galaxy-pay.org service
3.2.8 If, due to unforeseen circumstances (system error), the Client's account receives a larger amount than the amount specified in the application, the Client undertakes to return these funds to galaxy-pay.org.
3.3 The administration of galaxy-pay.org shall have the right:
3.3.1 Suspend the service for technical modernization or elimination of functional errors.
3.3.2. Suspend the current exchange (transaction), in case of a legitimate appeal of the competent authorities, administrations of payment systems Bitcoin, Litecoin..., as well as users with a complaint about fraud, for the time of clarification of circumstances.
3.3.3 Set and change the amount of discounts for the exchange of electronic money at its own discretion.
3.3.4. To set and change the amount of the commission charged from the client as a result of e-money exchange at its own discretion.
3.3.5. Refuse to provide services to any client without giving any reasons.
3.3.6. Require from the Client to confirm his/her affiliation with the electronic exchange by means of: E-mail, screenshot of the electronic wallet, as well as, if necessary, by means of a verification call to the phone number specified when filling in the exchange form, from which the funds were sent to make the electronic exchange, if this exchange ended in an error.
3.3.7 Stop correspondence or negotiations with the Customer if the Customer uses foul language, is rude, insulting, asks questions that are not related to the galaxy-pay.org support service or does not answer the questions posed by the support service.
3.3.8. Block the exchange according to clauses 5.4, 5.5 and 5.6 of the Regulations on Electronic Money Exchange.
3.3.9. block and not return funds to the Client until his/her identity is established (in cases of such necessity).
4. Services provided
4.1. galaxy-pay.org provides the following services: exchange of electronic money, on the site, https://galaxy-pay.org , namely the exchange of Bitcoin, Litecoin, Privat 24 with the possible use of banks specified on the site galaxy-pay.org provides services of cash exchange USD, EUR, UAH in partner cities, as well as provide a service of money transfers to any of the partner countries.
4.2. galaxy-pay.org provides the service of deposit in bitcoins and dollars
4.3. galaxy-pay.org does not check the eligibility and legality of the Client's possession of the funds offered for exchange.
5. Regulations on electronic money exchange
5.1 The exchange is deemed initiated when the galaxy-pay.org service receives from the Client the full amount intended for this exchange.
5.2 The exchange is considered completed when galaxy-pay.org transfers the amount intended for the Client or a third party to the payment details specified by the Client as a result of this exchange.
5.3 The exchange of electronic money cannot be canceled if it has already been started, as well as the return of the money that the Customer wanted to exchange.
5.4 In case of receipt from the Client of an amount different from the one specified when the exchange was initiated, galaxy-pay.org has the right to suspend the exchange, and in the future after the Client's request, according to clause 3.2.5, to pay the actually received amount, recalculated at the exchange rate that was in effect at the time of the exchange. 5.5. In case the Client has specified non-existing or blocked details, to which the amount should have been received as a result of the exchange, galaxy-pay.org may suspend the exchange, and later, after the Client's request, according to clause 3.2.5, return the funds to the account from which they were received, minus the commission fee of payment systems and a penalty of 2% of the returned amount.
5.6 In case of change of the payment note or payment of the issued invoice from another account the exchange can be blocked, and after the Client's request, according to clause 3.2.5 the exchange amount will be returned minus 1% of the exchange amount and payment systems commission.
5.7 When buying/selling Bitcoin for/in cash, the application is paid not later than 3 hours from the moment of its creation. Otherwise, galaxy-pay.org employees have the right to delete the application and require the client to make a new application on the site.
5.8 When exchanging Bitcoin for all directions, the phone number specified in the exchange details must correspond to the Client's personal phone number and be available for an incoming call.
6. Responsibilities of the parties
6.1. galaxy-pay.org Administration is not responsible and does not reimburse losses incurred in case of incorrect (unauthorized) use of the service, as well as Customer's mistakes made when filling out the exchange form, which may lead to the transfer of funds to the erroneously specified account, in this case it is impossible to cancel the exchange operation or return the funds back.
6.2. galaxy-pay.org shall not be liable for losses and/or damage (loss) incurred due to the Customer's inability to use its own equipment and/or its elements and/or lack of necessary full or partial functionality of the equipment or its elements.
6.3. galaxy-pay.org is not responsible for errors, omissions or delays in payments made by electronic payment systems and banks.
6.4. galaxy-pay.org reserves the right to set the exchange rate that is favorable to the company at the moment, this exchange rate may or may not coincide with the known and used currency exchanges.
6.5. galaxy-pay.org reserves the right to recalculate the exchange rate of an exchange transaction on an application that has been issued earlier, at the time of payment on the application.
6.6. galaxy-pay.org reserves the right to refuse to pay the client under the affiliate program, if it is detected by the galaxy-pay.org system that the client used this opportunity in order to get a discount on his own exchange (i.e. the application was made from the same IP address).
7. Change of information
7.1 This Agreement may be amended and supplemented by the administration of galaxy-pay.org; the amendments shall take effect from the date of publication of the Agreement on the Internet site https://galaxy-pay.org.
8. Force majeure
8.1 The Parties shall not be liable for any delay or failure to perform their obligations under this Agreement and/or the Arrangement as a result of force majeure, including (without limitation) acts of God, acts of governmental or regulatory authority, war, fire (fire), flood, explosion, terrorism, riot, civil commotion, hacker attacks, unavailability, non-functioning or failure of power supply, internet service providers, communication networks or other systems, networks and devices.
9. Mandatory conditions of exchange operations
9.1 It is prohibited to use the galaxy-pay.org service for illegal transfers and fraudulent actions. By using the GalaxyPay service, the Customer agrees that any attempt to exchange funds of dubious origin will be prosecuted in accordance with the current legislation of the country from whose territory the Customer performs exchange operations.
9.2 The administration of the galaxy-pay.org.io service reserves the right to provide information about such payments to competent authorities, administrations of payment systems, as well as victims of fraudulent actions upon their request, if the fact of illegal actions is proved.
9.3 The exchange is made on the condition that the Client with the help of the galaxy-pay.org Service withdraws digital signs only from his/her e-wallet and is responsible for the sources and methods of receipt to his/her e-wallet, due to the lack of possibility of verification of their origin by the galaxy-pay.org Service.
9.4 The galaxy-pay.org Service is not responsible for the exchange operations performed on behalf of the Client in favor of third parties.
9.5 The use of the galaxy-pay.org Service, after clicking the button "I agree with the exchange rules", means that the Client accepts all the requirements under this Agreement.
